Ontario Judge Rules in Favor of Woman Who Refused Covid Nasal Swab Test

‘I do decide that the nasal swab test, which the screening officer in this case required or demanded Ms. Fernando submit to, was an unlawful requirement or demand,’ wrote Ontario Court Justice Paul Monahan in his June 26 ruling.

BRAMPTON, Ontario (LifeSiteNews) — An Ontario court has ruled in favor of a woman who was charged and convicted for refusing to submit to a COVID nasal swab test upon returning home to Canada in 2022. 

In a June 26 ruling, Ontario Court Justice Paul Monahan decided in favor of Canadian woman Meththa Fernando, who was charged in 2022 for refusing a COVID nasal swab test when returning to Canada from abroad and subsequently found guilty. Monahan concluded that in Fernando’s case, requiring her to submit to such an invasive test was unlawful and ordered her conviction be overturned. 

“I do decide that the nasal swab test, which the screening officer in this case required or demanded Ms. Fernando submit to, was an unlawful requirement or demand,” wrote Monahan in his ruling.   

“Ms. Fernando’s refusal to comply with the requirement or demand was lawful on her part,” he continued. “Because the requirement or demand made of her by the screening officer was not lawful, Ms. Fernando should not have been found guilty by the Justice of the Peace.”  

Fernando began her legal journey in 2022 when she refused a nasal swab at Pearson International Airport in Toronto, Ontario. Upon her return home to nearby Mississauga, a screening officer from the Canadian Public Health Agency randomly selected her to undergo the nasal test.  

However, Fernando, who told the officer she was already vaccinated against COVID, refused the test. She was charged and later convicted of failing to comply with an order under Section 58 of the Quarantine Act and fined a total of $6,255. 

Canada’s Quarantine Act was used by Prime Minister Justin Trudeau’s government to enact severe draconian COVID travel rules on all returning travelers to the country. 

Fernando chose to take her case to an appeal court following conviction, arguing that the Quarantine Act did not “authorize a screening officer to use a screening test which involved the entry into the traveller’s body of an instrument or other foreign body.”   

During the hearing, Monahan admitted that this argument had “merit” since Section 14 of the Quarantine Act states, “Any qualified person authorized by the Minister may, to determine whether a traveller has a communicable disease or symptoms of one, use any screening technology authorized by the Minister that does not involve the entry into the traveller’s body of any instrument or other foreign body.”  

As LifeSiteNews previously reported there have been several instances of injuries after receiving the swabs, including leaking brain fluid due to the test puncturing the brain tissue.   

“The prosecution raised the point that perhaps the insertion into the nasal cavity did not involve the entry into the body,” Monahan stated. “I disagree. The insertion of a nasal swab into the nasal cavity is most definitely an insertion into the body.”  

“I am reversing the Justice of the Peace’s decision and entering a finding of not guilty,” he concluded. “Those are my reasons.”  

Besides potential brain tissue damage, COVID-19 nasal tests have been flagged for seriously questionable accuracy rates. One study authored by British and American scientists last year found that PCR nasal swab testing has only around 63 percent sensitivity. 

Severalotherstudies, as well as federalguidelines, have identified major accuracy issues with PCR tests and other means of testing for coronavirus. The most common PCR testing protocol for COVID-19 also has come under fire in December, when a coalition of scientists called for the retraction of the original article detailing the method, due to a lack of a properly peer-reviewed report. 

Pro-freedom lawyer Daniel Freiheit celebrated the decision, telling LifeSiteNews, “This ruling is a stark reminder that many laws may have been broken during COVID. I think this was caused by a collective fear of the unknown and a kind of mass panic.” 

“In times like that, it’s utmost to rely on first principles: basic freedoms that I had always been taught would act as checks and balances: freedom to speak, freedom to associate, freedom to deny novel medical treatment, right to retain counsel,” he continued.   

He explained that the ruling will give Canadians a sense of vindication since many knew the tests were invasive and unjust but complied out of fear.  

“Many people knew it was wrong and unlawful at the time but had no choice except to comply,” he said.  

“It was either that or face detainment at the border, harassment, fines, threats of more fines, threats of quarantine, etc,” Freiheit explained. “Submitting to this unlawful treatment was the easiest way out, especially for people coming into the country with medical conditions, tired children or frustrated travel partners.”  

This ruling is not the first time actions taken by the Trudeau government during COVID were found to be unlawful.

In January, the Trudeau government’s use of the Emergencies Act to end the Freedom Convoy protest against COVID mandates was ruled to have violated the Charter of Rights and Freedoms by Federal Court Justice Richard Mosley.  

According to the January ruling, the EA is meant to be reserved as a last resort if all other means fail. In Mosley’s judgement, this threshold was not met and thus, the Trudeau government violated the rights of Canadians.    

Shortly after the ruling, Trudeau announced that the government was appealing to the Federal Court of Appeal, a court where he has appointed 10 of the 15 judges.

Drug and human smugglers using stolen plates to evade law enforcement

Smugglers are stealing license plates from official vehicles in South Texas and mounting them on cars and trucks used to smuggle humans and drugs into the U.S., according to reports.

Authorities in Sabinal, a city near the southern border in Uvalde County, are noticing an uptick in license plate theft likely tied to organized crime.

The Sabinal Police Department provided a collection of recent incident reports to NewsNation correspondent Ali Bradley.

“Sabinal PD in Uvalde County says human/drug smugglers are swiping license plates from vehicles that belong to city officials and local residents and putting them on their vehicles in order to get past law enforcement,” Bradley reported on Thursday.

“The criminals are targeting generic vehicles like white trucks and SUVs which are often city/government vehicles.”

At least three such thefts were recorded in June while another was reported on Monday.

Sabinal Police Chief Jesus “Chuy” Reyes told Bradley that Border Patrol recently busted a smuggling operation involving a vehicle bearing locally-stolen plates.

Satellite Images Show Expansion of Alleged Chinese Spy Bases in Cuba

Chinese spy facilities have ‘evolving mission set’.

Satellite images suggest that the growth of Cuba’s electronic spy stations may be linked to China, including new construction at a previously unknown site located 70 miles from the United States’ naval base at Guantanamo Bay.

The study from the Center for Strategic and International Studies (CSIS), a Washington-based think tank, follows reporting from 2023 that said China and Cuba were negotiating closer defense and intelligence ties, along with establishing a new joint military training facility on the island and an eavesdropping facility.

According to U.S. officials who didn’t disclose their locations, Cuba and China were already jointly operating eavesdropping stations on the island. It is also unknown which of those are included in the sites covered by the CSIS report.

Former officials and analysts are worried about the stations because China could be using Cuba’s geographical proximity to the southeastern U.S. to spy on sensitive electronic communications from American military bases, space-launch facilities and military and commercial shipping sites.

Leland Lazarus, an expert on China-Latin America relations at Florida International University, warned that the Chinese facilities on the island could also strengthen China’s “use of telecommunications networks to spy on U.S. citizens.”

The White House and the Office of the Director of National Intelligence (ODNI) declined to comment on the matter.

After reviewing a year’s worth of satellite imagery, the authors of the CSIS report revealed that Cuba has noticeably upgraded and expanded its electronic spying facilities in recent years and targeted four sites at Bejucal, Calabazar, El Salao and Wajay.

Some of the sites described by CSIS, such as the one at Bejucal, have already been identified as listening posts. However, satellite imagery offers new information about their capabilities, growth over the years and possible links with China.

Chinese spy facilities have “evolving mission set”

Matthew Funaiole, a senior fellow at CSIS and the report’s chief author, explained that these are active locations “with an evolving mission set.”

The report suggested that two of the sites near Havana, Bejucal and Calabazar, have large dish antennas that seem to be designed to monitor and communicate with satellites. The report added that while Cuba lacks satellites, the antennas would be useful for China, which has a substantial space program.

According to the report, the newest dish antenna was installed at Bejucal in January. Additionally, the antenna and other infrastructure upgrades were discovered at the sites within the last decade.

The most recent of the four sites, which is still under construction and was not previously known publicly, is at El Salao, located outside the city of Santiago de Cuba in the eastern part of the country and is near Guantanamo.

Construction at El Salao started in 2021, and the site seems to be designed to hold a large formation of antennas known as a circularly disposed antenna array. These antennas can be used to find and intercept electronic signals, according to the report.

Funaiole said that, when complete, the site could potentially monitor communications and other electronic signals coming from the Guantanamo base. Both the U.S. and Russia have stopped using this sort of antenna array and replaced it with newer technologies, but China has been building them at some militarized outposts in the South China Sea.

China has played a more significant role on the island in recent years. According to a 2023 White House statement, China conducted an upgrade of its intelligence collection facilities in Cuba in 2019.

Meanwhile, Chinese officials claim that the U.S. has a global network of military bases and listening posts.

In a statement, Liu Pengyu, a spokesman for China’s embassy in Washington, wrote that America is “the leading power in terms of eavesdropping” and that it does not spare its allies. Pengyu also claimed that the U.S. constantly exaggerates China’s “establishment of spy bases or conducting surveillance activities in Cuba.”

29-year-old woman thrown off hood of her own car while trying to rescue her child from thieves

A young mother was killed in Ohio this week when she tried to stop a carjacker who stole her vehicle with her young child inside, authorities say.

The horrifying incident unfolded just after 1 a.m. on Thursday in Columbus.

Alexa Stakely, 29, was picking up her 6-year-old son from a babysitter after working late at her second job as a waitress.

She placed the sleeping boy inside her Honda SUV and started the vehicle, according to authorities.

However, Stakely realized she had forgotten something and returned to the front door of the babysitter’s residence to retrieve it.

As she walked back to her car, it began backing into the road.

The mother was seen running after the SUV and witnesses say they heard her screaming for her child, WYSX reports.

Stakely reportedly jumped on the hood of the Honda but was thrown off when the suspect began driving erratically.

Responding officers found Stakely lying in the street, suffering from a traumatic head injury.

The vehicle was abandoned a short distance away and the boy was found inside, unharmed.

Stakely was rushed to a local hospital where she succumbed to her injuries hours later.

“After the incident, two males were seen running past Stakely who was lying in the roadway. They continued running northbound, were observed jumping a fence, and disappeared into a neighboring apartment complex,” Columbus police explained in a statement.

“Earlier that morning, surveillance video caught a group of males looking into apartments in the area of Castenea Way. When confronted, the males proceeded eastbound further into the complex and out of view. Two of these males matched the description of the males seen at the incident.”

While authorities clearly have descriptions of the suspects, they have not released the information.

An investigation is ongoing.

‘We heterosexuals are creating the future because we make babies. Europe is dying out, babies are not being born, because of the excessive number of LGBTQ+,’ said Slovak politician Martina Šimkovičová.

(LifeSiteNews) — Slovakia’s minister for culture blamed the LGBT movement for Europe’s plummeting birth rates, arousing the ire of left-leaning ideologues.

During a July 3 interview with Slovak tabloid Topky.sk, Culture Minister Martina Šimkovičová blamed LGBT ideologies for Europe’s dropping fertility rates.

“We heterosexuals are creating the future because we make babies. Europe is dying out, babies are not being born, because of the excessive number of LGBTQ+ (people). And the strange thing is (that it’s happening) with the white race,” the minister said in comments cited by left-liberal news outlet Politico.

“We are living in an amoral era,” Šimkovičová elaborated.

In response to Šimkovičová’s July 3 comments, Peter Weisenbacher, director of the Bratislava-based Human Rights Institute, lodged a criminal complaint with the general prosecutor’s office against the minister, alleging that her remarks were racist and anti-Semitic.

In another interview, the minister admitted that “we are a sick society.”

In January, Šimkovičová revealed that the country’s culture ministry would cease financing LGBT projects.

“The LGBTI+ organizations (…) will no longer parasitize on the money from the culture department. I will certainly not allow it under my leadership,” Šimkovičová wrote on Facebook.

She added that she “rejects progressive normalization” and that her plans are for “a return to normality.”

Besides her anti-LGBT views, Šimkovičová has been noted for her tough stance on immigration, much to the chagrin of the globalist elites in the European Union (EU) and their ideological allies. To address the issue of Slovakia’s falling population, the EU elites have suggested bringing in migrants instead of encouraging Slovak families to have children.

Deputy Speaker of Parliament Andrej Danko from the junior coalition partner Slovak National Party said recently that Slovakia’s Culture Ministry will no longer bankroll movies with “themes crossing moral and ethical boundaries, including LGBTQ+,” Politico added.

According to Macrotrends data, the current birth rate for Slovakia in 2024 is 9.677 births per 1,000 people, a 1.39% drop from a year earlier.

Šimkovičová is not the only Slovak politician to support her nation’s families and thus reap the left-wing whirlwind. Since his fourth stint as Slovakia’s prime minister in October 2023, incumbent Robert Fico has also been vilified by the pro-LGBT EU for his pro-family values, his anti-war stance with regard to the Russo-Ukrainian conflict, and his sovereigntist approach to governance.

He has also nearly been killed. In May, Fico was shot and gravely wounded in what Slovak officials portrayed as a “politically motivated” assassination attempt in the town of Hándlova, based on media reports. Observers like Slovakia Interior Minister Matus Sutaj Estok have since noted that Fico’s shooter, Juraj Cintula, did not commit the crime alone. There is evidence that “the crime may have been committed by a certain group of people” as Cintula’s online “communication history” was deleted merely two hours after his failed attempt on Fico’s life. While Fico fortunately survived,  his health has been seriously undermined, according to Slovakia Deputy Prime Minister and Minister of Defence Robert Kaliňák.

“His health is still far from ideal. After a gunshot wound to the abdomen, those organs don’t work the way they did when you were 17 or 30. It’s still very erratic. As part of his regular rehab, doctors are doing everything they can to make sure he can do his job to his full potential, and we’re getting close to that,” Kaliňák was cited by the Euronews news portal as saying.
