Social media giant X has faced a significant legal setback in Australia. The Queensland Civil and Administrative Tribunal (QCAT) has ruled that the company can be held accountable for so-called “hate speech” published on its platform. This landmark decision came in response to a complaint lodged by the Australian Muslim Advocacy Network (AMAN) in July 2022. AMAN accused X of permitting a “far-right conspiracy group” to post hateful and denigrating comments about Muslims.

Social media companies like X have traditionally argued that they are not responsible for content on their platforms that originates outside the jurisdictions where they do business. However, this ruling ignores that notion, suggesting the platform is responsible for the speech of its users.

Despite AMAN’s requests, X refused to remove or block the offending posts under Queensland’s Anti-Discrimination Act. Elon Musk, the owner of X, argued that his company should be exempt from these laws due to its US-based operations.

Rita Jabri Markwell, AMAN’s legal advisor, countered this defense, asserting that X profits from local markets and communities in Australia by collecting data and selling advertisements. She believes this ruling could set a precedent in other jurisdictions, challenging the long-held legal protections social media companies have relied upon. She emphasized the broader implications, saying, “This could become a precedent that will carry weight in other jurisdictions, whether it’s at the federal level or under other vilification laws.”

The QCAT decision follows a dispute between Australia’s online safety regulator and X over the platform’s refusal to remove video footage of a stabbing incident involving Bishop Mar Mari Emmanuel in April, which was live-streamed. In Australia, X hid 65 tweets containing the video rather than complying with a takedown order. Although eSafety commissioner Julie Inman won an interim order in the Federal Court, the ban was not made permanent.

AMAN is also awaiting a separate ruling on whether X breached the law by failing to remove or hide the alleged hate speech. Additionally, AMAN has a legal complaint against Meta and Facebook Australia pending before the Human Rights Commission. Meta, like X, has argued against the applicability of Australian law, particularly in the context of the Cambridge Analytica scandal, maintaining that it is not subject to local jurisdiction.

The Democrats are insisting on holding the debates sooner rather than later, so they can evaluate Biden’s “mental acuity” and replace him if needs be, according to journalist John Fund.

Fund made the claim in a interview with GB News in which he discussed Biden’s mental issues at length.

“Well, very simply, there has to be an explanation why Joe Biden insisted on a debate in early June, which is the earliest any debate will have been held,” he said.

“It will be held both before the Republican convention and the Democratic Convention. I can only draw one conclusion and that is [to do with] Joe Biden’s shall we say, ‘mental alertness issues.’”

Fund speculated that if Biden performed poorly, this would give the Democrats time to replace him at the Convention, even though the Convention “has been in lockstep with whoever has won the primaries.”

“Conventions can change their mind,” Fund added.

He also noted that, even if Biden isn’t replaced, holding the debates as early as possible will help to reduce any negative effects on the election in November.

Fund also warned that “expectations are too high for him,” which could play into his opponent’s hands during the debates.

“It’s also a trap set up for Trump, because most people think that Donald Trump would win the debate, at least on style points, because he’s aggressive and forceful and Biden is not.

“On the other hand, Biden has shown he can wield very sharp rhetoric against Trump.”

Donald Trump has vowed to protect cryptocurrency users and said he would never allow the creation of a central bank digital currency.

Trump was speaking at the Libertarian National Convention in Washington DC on Saturday night when he made the promises to safeguard America’s burgeoning cryptocurrency scene from regulation.

“I will ensure the future of crypto and the future of Bitcoin will be made in the US and not driven overseas. I will support the right to self-custody,” he said.

Trump also had Senator Elizabeth Warren firmly in his sights. Warren has proposed that the crypto industry be subject to the same rules as other financial organizations in the US, and highlighted the use of cryptocurrency to pay for child-abuse material. She has been accused of leading an “anti-cryptocurrency crusade” by some.

“To the nation’s 50 million crypto-holders I say this: with your vote, I will keep Elizabeth Warren and her goons away from your Bitcoin. And I will never allow the creation of a central bank digital currency.”

Trump also made headlines with his speech by claiming that he would pardon the 6 January “hostages” and commute the sentence of Silk Road founder Ross Ulbricht, who has spent 11 years in jail as part of a term of life without parole.

Trump is the first president to address the Libertarian National Convention. No current or former president in the modern era has ever addressed a convention for a party other than the Democrats or the Republicans.

The deadline for negotiations passed on Friday

After two years of wrangling, negotiators from the World Health Organization’s 194 member nations failed to reach agreement on a so-called “pandemic treaty.”

On Friday, Tedros Adhanom Ghebreyesus, the WHO’s director general, announced that the deadline for negotiation ahead of this week’s World Health Assembly had passed.

The pandemic treaty would have included binding provisions for ratifying nations to implement in the event of another pandemic, including on the distribution of vaccines. The idea of a pandemic treaty was born during the COVID-19 pandemic, in response to apparent failures to coordinate among nations and organizations.

One particular sticking point during the negotiations was the willingness of wealthier countries to agree to share medical treatments with poorer countries.

In the US, lawmakers were worried that any potential agreement might infringe on proprietary information and stifle investment in drug development.

There has also been significant concern voiced, in the US and elsewhere, about emergency powers that might be granted to the WHO, especially the ability to define what a pandemic is, when one is in progress and how long it lasts.

There have been calls, including from Senators Tom Cotton and Steve Daines, for the US to leave the WHO altogether. In a letter to President Biden, the two senators wrote, “The WHO has demonstrated an abysmal lack of competence throughout the COVID-19 pandemic, which has destroyed the organization’s credibility and undermined the public’s confidence in it.”

Despite the failure of negotiations, Tedros is confident an agreement will eventually be reached.

“The world still needs a pandemic treaty. Many of the challenges that caused the serious impact during COVID-19 still exist,” he said.

“So let’s continue to try everything.”

It’s believed that the WHO will allocate another six to 12 months for further negotiations.

The attacker’s Instagram has been “scrubbed”

Jared Ravizzia, who went on a stabbing spree on Saturday night, appears to be transgender, according to reports on social media.

Wearing a long blonde wig and a flamboyant costume, Ravizzia, 26, of Martha’s Vineyard, attacked a group of little girls watching the movie “IF” at a Braintee, Massachusetts theater, before making his escape in a Porsche SUV. He drove to a rest stop 30 miles away and attacked two other people at a McDonald’s.

“Without saying anything and without any warning, he suddenly attacked and stabbed the four young females,” the Braintree Police Department said in a statement.

“The attack appeared to be unprovoked. After the attack, the man ran out of the theater and left in a vehicle.”

He was apprehended by law enforcement on Saturday evening and charged with assault with intent to murder and battery with a dangerous weapon.

It’s also believed Ravizzia may be linked to a murder in Deep River, Connecticut. Police found a body in the town at 3.30 pm on Saturday and issued an alert for a suspect, describing him as “armed and dangerous” and carrying a large knife.

Ravizzia’s strange attire, and the fact that he began his spree in a theater filled with little girls, attracted instant attention from users of social media.

One user noted that Jared’s Instagram account, which could provide vital evidence about his identity and motivations, had now been “scrubbed,” but provided a screenshot that apparently shows Ravizzia identified as a female, listing his preferred pronoun as “she.”

The user berated The New York Post for describing Ravizzia as a “madman.”

“This is not a “madman”, this is not someone that saw themselves as a cishet male—this is a transgender woman that attacked multiple girls STOP COVERING FOR MEN LIKE THIS.”

One of the mothers of the girls attacked in the theatre told reporters that Ravizzia was “laughing during the stabbings.”
